Decree no. 12 of 2019 regarding the Appointing of Judges in the Dubai Courts

 

We, Mohammed Bin Rashid Al Maktoum, Ruler of Dubai

After reviewing law no.10 of 2009 regarding the salaries of the Dubai Judicial Authority’s members,
and Law no.13 of 2016 regarding the Dubai Judicial Authority
and Regulation no. 2 of 2009 regarding the non-citizen judges’ salaries in Dubai,

and based on the recommendation of the Dubai Judicial Council,

 

We have decided the following,

 

Appointment of Judges
Article 1

The following shall be appointed as judges in the Courts of First Instance
1. Hamdi Mahmoud Khalifa Tolba
2. Taha Amin Taha Abou El Ola
3. Qurashi Mohammed Saad Hussein
4. Mohammed Tharwat Abdelmoneim El Sayed Ismail
Each is to be granted a monthly salary and a financial allocation for the purpose of commencing as a primary judge according to Law no. 10 of 2009 in addition to a salary schedule and the non-citizens’ judges financial allocations pursuant to Regulation no. 2 of 2009.

 

Validity and Publication
Article 2

This decree shall be effective from the 13th of January, 2019 and is to be published in the Official Gazette.

Decision no. 9 of 2019 regarding the formation of the Dubai Equestrian Club Board of Directors

 

We, Mohammed Bin Rashid Al Maktoum, Ruler of Dubai

After reviewing Decree no. 32 of 2005 regarding the establishing of the public entity known as the “Dubai Equestrian Club”
and Decree no. 28 of 2015 regarding the governance of the boards and committees pursuant to the Government of Dubai
and Decision no. 3 of 2016 regarding the formation of the Dubai Equestrian Club’s Board of Directors

 

We have decided the following,

 

Formation of the Board of Directors
Article 1

a. The Dubai Equestrian Club’s Board of Directors is to be formed with Her Royal Highness Princess Haya Bint Al Hussein as its chairman, and the following as its members:
1. Saeed Bin Humaid Matar Al Tayer – Vice Chairman
2. Maleeh Lahej Al Basti – Member
3. Mohammed Ahmed Abdulaziz Al Shahi – Member
4. Hamad Mubarak Mohammed Bouamim – Member
for a renewable period of three years.
b. Should the membership period of the members listed in paragraph a end, and the Board of Directors has not been restructured, the members shall continue to perform their duties until they have been re-appointed or others are appointed as their alternatives.

This Decision is to be effective from the date of its issuing and is to be published in the Official Gazette.

Administrative Decision no. 43 of 2019 regarding granting some of the employees of the Dubai Health Insurance Company within the Dubai Health Authority judicial control capacity

 

General Manager

After reviewing Law no. 11 of 2013 regarding the Dubai health insurance
and Law no. 32 of 2015 regarding the Government of Dubai’s Official Gazette,
and Law no. 8 of 2016 regarding the organizing of the granting of the judicial control capacity in the Government of Dubai,
and Law no. 6 of 2018 regarding the Dubai Health Authority and is referred to as the “Authority” hereafter,
and Decree no. 17 of 2018 regarding the establishing of institutions pursuant to the Dubai Health Authority and specifying their specilizations,
and Decree no. 18 of 2018 regarding the appointment of the Dubai Health Authority’s general manager,
and the Executive Committee’s Decision no. 7 of 2016 regarding the fees and fines in relation to Dubai’s health insurance,
and the Executive Committee’s Decision no. 6 of 2017 regarding the adoption of the application of the stages of the health insurance in Dubai,
and the Executive Committee’s Decision no. 18 of 2018 regarding the adoption of the Dubai Health Authority’s organizational structure,

 

We have decided the following,

 

Granting Judicial Control Capacity
Article 1

Some of the Dubai Health Insurance Institution employees, whose names and professions are listed in the Authority, are to be granted judicial control capacity in relation to the actions that are committed in breach of the provisions of Law no. 11 of 2013.

 

Judicial Control Officers’ Obligations
Article 2

Pursuant to Article 1 of this Decision, the employees that are granted judicial control capacities are to abide by the following:
1. The provisions of Law no. 11 of 2013, and are to abide by the procedures listed within while performing their duties.
2. Ensuring that the individuals addressed by law no. 11 of 2013 are abiding by its provisions, the duties imposed on them, the decisions issued pursuant to it, and are not violating its provisions.
3. Monitoring the breaches they are assigned to monitor and collecting information and evidence in relation to them.
4. Receiving the complaints and notifications that are addressed to them in relation to the breaches that relate to their professions.
5. Taking the appropriate measures in order to retain all the evidence relating the the committed breaches.
6. Issuing minutes in relation to the procedures they undertook.
7. Ensuring integrity, impartiality, and objectivity while performing their duties.
8. Presenting verification of identity when performing the assigned tasks.
9. Not exploiting the judicial control capacity for their personal advantage or gain.

 

Judicial Control Officers’ Capacities
Article 3

The employees that are granted the judicial control capacities pursuant to Article 1 of this Decision have the following capacities:
1. The use of police officers when necessary.
2. The use of experts and translators when necessary.
3. Hearing and writing the complainants’ and witnesses’ statements.
4. Asking questions and inquiries and entering areas and places they are authorized to enter in order to collect information relating to the committed breach.

 

Executive Procedures
Article 4

The executive manager of the Dubai Health Insurance Institution within the Authority is to undertake all the necessary procedures in order to implement this Decision’s provisions, including:
1. Issuing identification cards for the judicial control officers governed by Article 1 of this Decision.
2. Adopting the minutes of the committed breaches templates including the basic data, and in accordance with the provisions of Law no. 8 of 2016.

Administrative Decision no. 245 of 2019 regarding the cancellation of the judicial control capacity in relation to some of the employees of the Licensing Institution of the Road and Transport Authority

After reviewing Law no. 17 of 2005 regarding the establishing of the Road and Transport Authority and its amendments, hereafter referred to as the “Authority”,
and Law no. 32 of 2015 regarding the Dubai Official Gazette,
and Law no. 8 of 2016 regarding the organizing of the granting of the judicial control capacity in the Government of Dubai,
and Executive Committee Decision no. 8 of 2008 regarding the establishing of the Licensing Institution within the Road and Transport Authority,
and Executive Committee Decision no. 8 of 2006 regarding the establishing of the institutions pursuant to the Road and Transport Authority and adopting its organizational and regulatory structure,
and Executive Committee Decision no. 47 of 2018 regarding the adoption of Road and Transport Authority’s organizational structure,
and Administrative Decision no. 771 of 2017 regarding granting some of the Road and Transport Authority’s employees judicial control capacity.

 

We have decided the following:

 

Cancelling the Judicial Control Capacity
Article 1

a. The judicial control capacity granted to the following pursuant to Administrative Decision no. 771 of 2017 is to be cancelled:
1. Mohammed Walled Nobhan
2. Ahmed Fouad Mohammed Al Qawraba
b. The aforementioned employees in paragraph a are to abide by the following:
1. Not to exercise any of the effective judicial control officers’ capacities.
2. Returning the identification card provided to them as judicial control officers.
3. Returning all the minutes that they possess, in addition to all the documents and tools that have been provided to them in order to monitor the actions committed in breach of the effective provisions.

Article 2

This Decision is effective from the date it is issued, and it is to be published in the Official Gazette.

and Law no. 32 of 2015 regarding the Dubai Official Gazette,
and Law no. 8 of 2016 regarding the organizing of the granting of the judicial control capacity in the Government of Dubai,
and Decree no. 12 of 2006 regarding the transferring of some of the duties and responsibilities from the Dubai Municipality to the Road and Transport Authority,
and Local Decision no. 30 of 1986 regarding the monitoring of the Dubai advertisements,
and Executive Committee Decision no. 8 of 2006 regarding the establishing of the institutions pursuant to the Road and Transport Authority and adopting its organizational and regulatory structure,

We have decided the following:

 

Granting the Judicial Police Capacity
Article 1

The Road and Traffic Institution employees within the Authority which lists their names and titles in the schedule are to be granted judicial control capacity in order to monitor actions committed in breach of Local Decision no. 30 of 1986 in the advertisement sites supervised by the Authority in accordance to Decree no. 12 of 2006.

 

Judicial Control Officer’s Duties
Article 2

The employees that are granted the judicial control capacities pursuant to Article 1 of this Decision are to abide by the following:
1. The provisions of Local Decision no. 30 of 1986, in addition to the procedures listed within.
2. Ensuring that the individuals governed by Local Decision no. 30 of 1986 abide by their duties, decisions issued pursuant to Decision, in addition to refraining from violating its provisions.
3. Monitoring the breaches they are assigned to monitor and collecting information and evidence in relation to them.
4. Receiving the complaints and notifications that are addressed to them in relation to the breaches that relate to their professions.
5. Taking the appropriate measures in order to retain all the evidence relating the the committed breaches.
6. Issuing minutes in relation to the procedures they undertook.
7. Ensuring integrity, impartiality, and objectivity while performing their duties.
8. Presenting verification of identity when performing the assigned tasks.
9. Refraining from exploiting the judicial control capacity for their personal advantage or gain.

 

Judicial Control Officers’ Capacities
Article 3

The employees that are granted the judicial control capacities pursuant to Article 1 of this Decision have the following capacities:
1. The use of police officers when necessary.
2. The use of experts and translators when necessary.
